Obsessed Auto Repair Inc

 

These Terms and Conditions govern all services, transactions, website use, and facility access related to Obsessed Auto Repair Inc ("the Shop"). By using our services, booking repairs, authorizing work, or accessing our website, you agree to these Terms and Conditions.

 

1. Services

  • The Shop provides automotive diagnostics, maintenance, mechanical repairs, electrical repairs, inspections, performance services, and related automotive services.

  • All services are subject to availability of parts, labor, equipment, and technician capacity.

  • The Shop reserves the right to refuse service for safety, legal, ethical, operational, or compliance reasons.

2. Estimates and Repair Authorizations

  • All estimates are non-binding unless stated in writing and signed by an authorized representative.

  • Final costs may increase due to hidden damage, additional faults, safety issues, seized components, corrosion, or previously undisclosed conditions.

  • Authorization to proceed may be given verbally, digitally, via text/email, or in writing and is legally binding.

  • Digital approvals, SMS approvals, and electronic signatures are legally valid authorizations to perform work.

3. Diagnostic Fees

  • Diagnostic services are billable regardless of repair approval.

  • Diagnostic fees cover testing time, labor, and equipment usage.

  • No diagnosis guarantees a repair outcome.

4. Payment Terms

  • Full payment is due immediately upon completion of service unless otherwise agreed in writing.

  • Accepted payment methods are determined by the Shop.

  • Vehicles will not be released until full payment is received.

  • Non-payment may result in storage fees and enforcement of lien rights under New York State law.

5. Storage Fees

  • Vehicles left more than 48 hours after repair completion or repair declination will incur storage fees.

  • Storage fees: $75 per day (unless otherwise posted on-site or on invoice).

  • Storage fees apply including weekends and holidays.

6. Abandoned Vehicles & Garage Lien (New York)

  • Vehicles unpaid or unclaimed may be processed as abandoned under New York State Lien Law.

  • The Shop reserves the right to file a mechanic’s lien and pursue sale of the vehicle to recover unpaid balances, storage fees, and legal costs as permitted by law.

7. Parts Policy

  • Repairs may use OEM, aftermarket, remanufactured, rebuilt, or used parts.

  • Parts availability, quality, and warranty coverage vary by supplier.

  • Customer-supplied parts are installed at customer risk and are not warrantied for fitment, function, or reliability.

8. Warranty Policy

  • Labor warranty: 12 months / 12,000 miles, whichever occurs first, unless otherwise stated on the invoice.

  • Parts warranty is limited to manufacturer or supplier warranty only.

  • Warranty does not cover:

    • Misuse or abuse

    • Accidents or collisions

    • Overheating

    • Improper maintenance

    • Neglect

    • Track use or racing

    • Performance driving

    • Unauthorized modifications

    • Unauthorized repairs by third parties

    • Electrical faults caused by aftermarket components

9. No-Start / No-Fix Disclaimer

  • No diagnosis or repair guarantees that a vehicle will start, run, or remain operational.

  • Intermittent electrical, mechanical, or computer-related faults may reoccur.

  • The Shop is not liable for future failures unrelated to the performed repair.

10. Performance Modifications Disclaimer

  • Performance upgrades, tuning, custom fabrication, engine modifications, exhaust systems, suspension changes, and ECU modifications are performed at customer risk.

  • No performance outcome, horsepower gain, fuel economy improvement, or reliability outcome is guaranteed.

  • Modified vehicles may void manufacturer warranties and fail inspections.

11. Towing Policy

  • The Shop is not responsible for damage caused by third-party towing companies.

  • Towing fees are the customer’s responsibility unless otherwise stated in writing.

12. Insurance Claims

  • The Shop does not guarantee insurance coverage or claim approval.

  • Customers remain responsible for all charges not paid by insurance carriers.

  • Deductibles are the sole responsibility of the customer.

13. Customer Responsibilities

  • Provide accurate contact and vehicle information.

  • Remove all personal property and valuables before service.

  • Disclose known mechanical issues, prior repairs, modifications, and aftermarket equipment.

14. Liability Limitations

  • The Shop is not responsible for:

    • Pre-existing damage

    • Loss or theft of personal items

    • Data loss from vehicle systems

    • Indirect or incidental damages

    • Supplier delays

    • Parts backorders

    • Manufacturer defects

15. Appointments and Cancellations

  • Appointments are subject to availability.

  • Missed appointments or late cancellations may result in service fees.

16. Website Terms

  • Website content is for general information only.

  • The Shop does not guarantee accuracy, availability, or uninterrupted access.

  • Unauthorized use of content is prohibited.

17. Privacy Policy

  • Customer data is collected for service, communication, billing, and legal compliance.

  • Customer information is not sold or shared except as required by law or for service fulfillment.

18. Dispute Resolution

  • All disputes must first be addressed directly with Shop management.

  • If unresolved, disputes shall fall under the jurisdiction of New York State courts.

19. Governing Law

  • These Terms and Conditions are governed by the laws of the State of New York.

20. Changes to Terms

  • The Shop reserves the right to modify these Terms and Conditions at any time.

  • Updated terms apply immediately upon posting or use of services.
